General Conditions of “Confirmation Fax – Letter – E-mail” Agreement
Stipulation, payment terms and conditions
At the booking the Applicant shall pay the confirmatory deposit, amounting to 50% of the total tenancy fee, in favour of Il Mare Company, whereas the settlement of the remaining part, the payment of the utility expenses and of the guarantee deposit for possible damage, shall be made at the premises of Il Mare by the Applicant/Client before the beginning of the agreed or booked tenancy period. The payment can be made only by cash or by bank cheque. The “Confirmation Fax, Letter or E-mail” Agreement shall be shown to the reception for the delivery of the keys.
Departures and arrivals
The Tenant can check at 5:00 p.m. of the arrival day indicated in this Agreement (see next item ”Important communications” ) and must check out within and not later than 10:00 a.m. of the departure day indicated in this Agreement. Should the Client be unable to enter the apartment from the booked day or at the communicated expected arrival time, due to any inconvenience encountered during the trip, to strikes or to personal reasons, no refund is provided. The lease fee cannot be split for periods shorter than the one established with the booking and a refund is expressly excluded after the beginning of the tenancy period in case of anticipated departure of the Tenant(s).
Withdrawal of the Client
The Client who recedes from the Agreement for any reason, will be expected to pay, by way of penalty, including expenses, the sums listed below. These sums can be directly deducted from the amount paid at the booking.
10% of the total rental fee up to 40 days before the beginning of the stay; 30% of the total rental fee from 39 to 18 days before the beginning of the stay; 50% of the total rental fee from 17 to 10 days before the beginning of the stay; 75% of the total rental fee from 9 to 7 days before the beginning of the stay; 100% of the total rental fee after these terms. The notice to quit must be given providing a written document.
Alternative to or cancellation of the trip Agreement by Il Mare Company
Il Mare Company retains the right to replace the apartment booked for renting with another of the same level and quality in case of exceptional circumstances. In case of force majeure, wars, calamities or in any case for circumstances beyond its control, Il Mare Company can cancel the Agreement returning the paid sum.
At the delivery of the keys the Client must pay a guarantee deposit to the reception, which can be paid cash or by bank cheque. If such guarantee deposit is not paid, the person in charge for reception reserves the right not to deliver the keys. The occupation of the premises is limited to the number of residents indicated in the present Agreement and prohibition on subletting is imposed. In case of exceeding this number, the person in charge has the right of refusing the exceeding persons to enter the premises. The Tenant agrees to occupy the premises respecting all the rules of the good neighbourhood and/or any regulations of co-ownership. The cleaning of the kitchenette, dishware and kitchen tools must be performed by the Client as it is not included in the final cleaning. The guarantee deposit will be entirely refunded upon departure, following inspection of the premises which are the object of this lease agreement and verification if the same suffered any damage or even minimal alterations relative to the initial conditions of the given premises. Should the Client’s departure take place in times other than the reception opening ones, the guarantee deposit will be sent to the Client’s usual address; if deemed possible, Il Mare will refund the deposit paid the evening before departure.
Liability for damage or delay in leaving the premises
In the event of a delay in leaving the property at the expiry of the agreed period due to the fault of Tenant, he/she will be liable to pay a sum amounting to 1,000.00 euros for each day of delay in relation to the one scheduled for departure. The Tenant/Client will be liable to pay any possible further damage caused to Il Mare Company or to third parties, due to the failure to make the property available – even though caused by third parties – even including non-contractual losses. In case of damage caused by third parties, the Client/Tenant remains liable pursuant to article 2051-2055 of Civil Code, jointly. The Tenant/Client declares to hold Il Mare Company harmless from any damage to itself or to third parties, for any reason present in the premises, for prejudicial events occurred inside the premises which are the object of this lease agreement or in its appurtenances limited to the period in which the premises were (are) at his/her disposal.
The Tenant/Client personally undertakes liability for direct or indirect damage, caused to the premises or to third parties, due and/or attributable to his/her behaviour or neglect or due and/or attributable to third parties’ behaviour or neglect, for any reason, present in the property, and he/she engages in holding Il Mare Company harmless and/or to exempt it from any claim from damages. The Tenant/Client, at the moment he/she physically leaves the rented premises, declares that the premises have been inspected, no anomaly or absence has been found neither inside nor outside the property and that he/she found the premises perfectly suitable for residential use, unconditionally, and engages to leave the property in the same conditions as it was at his/her arrival.
The Client must communicate the expected arrival time at the reception not later than 7 days before the beginning of his/her stay. Failure to communicate the arrival time exempts Il Mare Company from receiving the Client after the following office times:
− Monday to Friday from 9:00 a.m. to 1:00 p.m. and from 4:00 p.m. to 8:00 p.m.;
− Saturday from 9:00 a.m. to 1:00 p.m. and from 3:30 p.m. to 8:00 p.m., extended until 11:30 p.m. only in case the Client communicated his/her arrival;
− Sunday from 9:00 a.m. to 1:00 p.m. extended from 4:00 p.m. to 8:00 p.m. only in case the Client communicated his/her arrival;
Sunday to Friday arrivals after 8:00 p.m. need not only to be communicated in advance, but also to be approved by the reception and, if authorisation is given, the payment of an additional charge of 25.00 euros per apartment will be required.
Il Mare Company is not liable for objects or money left unattended in the premises during the stay or forgotten at the departure. Notice is made that during the summer period the Town Council of San Teodoro may promulgate resolutions obliging to use water only for personal and/or food-grade use and not for drinking consumption.
Pets are not allowed. At the time of the booking, the booking office reserves the right to accept them according to the type of pet and of apartment. The possible acceptance (indicated in writing in the Agreement) requires the payment of a deposit of 250.00 euros and the payment of 90.00 for final cleaning.
Any modification, change, addition to be made concerning the clauses included in this Agreement or affecting them in some way, must result from a written document.
The competent Court of Nuoro shall have exclusive jurisdiction for any dispute which may arise out of or in connection with these terms and conditions.
